BANK CHECK Have you ever had your bank check to see if your checks meet all the requirements of the new Check 21 Act? The odds are long that they have not because, if you read the check requirements under the new Check 21 legislation, in most cases you will find that your current bank check does not comply. In fact, if you purchase one of your banks’ cashier checks, it is very likely its cashiers check does not comply either. So what is the purpose of the law if very few banks themselves are complying and what does the Check 21 Act mean? Check 21 is short for “The Check Clearing for the 21st Century Act” and it is a direct result of the Twin Tower September 11th terrorist attacks. In those days and weeks after so many innocent people died, all airline traffic screeched to a halt. Check processing between banks relied almost exclusively on air freight for moving the checks that you had written from one bank to another for clearing. In effect, money stopped moving and, as a result, in October of 2003 the House and Senate passed similar versions of Check 21 legislation and the final bill was signed by the President and went into effect October 28th of 2004. The meat of this Check 21 Act encourages the replacement of your paper check with a digital image early in the bank processing cycle. This image removes the need to transport your check physically between banks for processing and provides for speedier clearing. It also means when Check 21 is fully implemented you will not get that paper check back with your bank statement but instead will get a sheet of images of your cancelled checks. Your financial institution also is given the option of storing or destroying your paper checks after digitally imaging them. One of the ramifications of this Check 21 Act was the early on discovery that many checks are printed with too much background clutter to provide a clear digital image. Background clutter in this case means the security pantographs and other security features in the body of many paper checks. Some of the “VOID” pantographs used in the past to discourage fraud are now considered “clutter”. The checks guilty of background clutter include many checks you now use and almost all bank cashiers checks. Because of the millions of dollars worth of cashier checks banks presently own they are dragging their feet on replacing them with new ones to comply with the Check 21 regulations.
